Therefore:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>Do not enter any personal data: <\/b><span style=\"font-weight: 400;\">Since entering personal data constitutes data processing, you should really refrain from feeding such data into AI tools.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>Protect classified\/internal data of the organization: <\/b><span style=\"font-weight: 400;\">Internal organizational data should also not be passed on to AI systems without further ado in order to avoid data leaks and unauthorized access.<\/span><\/li>\n<\/ul>\n<p><b><\/b><\/p>\n<h4><b>Copyright<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">AI systems cannot assert their own copyrights, as copyright is reserved for humans only. This means:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>Users are not automatically authors:<\/b><span style=\"font-weight: 400;\">Content generated by KI does not constitute copyright infringement. However, the user of the AI is not necessarily the author.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>Customize texts<\/b><span style=\"font-weight: 400;\">: To ensure that the content created is protected by copyright, the user should adapt the AI-generated texts in such a way that <\/span><b>original creative<\/b> <span style=\"font-weight: 400;\">work is created. Once this is done, copyright law also applies.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>Documentation of AI usage<\/b><span style=\"font-weight: 400;\">: Be sure to document which content was created with the help of AI. This could become important in the future if a labeling requirement for AI-generated content is introduced.<\/span><\/li>\n<\/ul>\n<p><b><\/b><\/p>\n<h4><b>Open Source<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">If open source code is used when using AI systems in software development, certain licenses must be observed:<\/span><\/p>\n<ul>\n<li aria-level=\"2\"><span style=\"font-weight: 400;\">If AI-generated code is based on open source code, the resulting code must also be placed under the corresponding open source license.<\/span><\/li>\n<\/ul>\n<p><b><\/b><br \/><b><\/b><\/p>\n<h4><b>Employment law &#8211; use of AI by employees<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">The use of AI by employees should be clearly regulated contractually and technically:<\/span><\/p>\n<ul>\n<li aria-level=\"2\"><b>conclude an data processing contract\/agreement with OpenAI (the company behind ChatGPT) <\/b><span style=\"font-weight: 400;\">in order to legally secure the data processing by the AI.<\/span><\/li>\n<\/ul>\n<ul>\n<li aria-level=\"2\"><b>Employee policy:<\/b><span style=\"font-weight: 400;\">An internal policy for dealing with AI can reduce the organization&#8217;s liability. This should regulate how employees are allowed to use AI tools.<\/span><\/li>\n<\/ul>\n<ul>\n<li aria-level=\"2\"><b>Customers:<\/b><span style=\"font-weight: 400;\">If AI is used in customer communication, the customer&#8217;s consent should be obtained. A clear <\/span><b>Data protection declaration <\/b><span style=\"font-weight: 400;\">is <\/span><b>essential here<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<p><b><\/b><br \/><b><\/b><\/p>\n<h4><b>Open approach to the use of AI<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">Transparency is the key to the responsible use of AI:<\/span><\/p>\n<ul>\n<li aria-level=\"2\"><span style=\"font-weight: 400;\">Concerning <\/span><b>data policy<\/b> <span style=\"font-weight: 400;\">specify: Even if there is currently no obligation to state the use of AI in the General Terms and Conditions (GTCs), an open and honest approach is recommended. This could soon become mandatory.<\/span><\/li>\n<\/ul>\n<ul>\n<li aria-level=\"2\"><b>Liability of the organization: <\/b><span style=\"font-weight: 400;\">Regardless of what the AI says or does, the entrepreneur is ultimately liable.<\/span><\/li>\n<\/ul>\n<p><b><\/b><\/p>\n<h2><span style=\"font-weight: 400;\">Looking into the crystal ball? <\/span><span style=\"font-weight: 400;\">Future legal regulations<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">New AI laws will come into force.
